Tier2 ICT dependent to Tier2 general dependent

Post by shrutis » Tue Jun 26, 2018 12:33 pm

Hi,
My husband is on Tier2 ICT visa and I am his dependent.
We want to change to Tier2 General and for that we will be doing an year cooling off . I would like to know if I (dependent ICT Tier2) will be required to do a cooling off too or I can stay in UK or be employed in UK (and working from home from some other country for an year or so) and then just apply for Tier2 general dependent along with my husband after his cooling off is over.

Thanks in advance

Dependent visa is always in line with the primary visa holder.
If the primary visa holder leaves the country at the end of visa tenure, the dependent is supposed to leave as well. Therefore, you cannot stay in country after the primary applicant has left.
In terms of employment, if the employer permits to work out of country, then its fine.
Once your spouse gets a new visa, after the cooling off period, you can apply as a dependent and travel back .
Have you not thought of getting yourself a tier 2 gen visa ?
As dependents are not subject to cooling off period.

Hi,

I am in a similar situation. I am currently working with a A-rated sponsor and asked if they can offer a CoS for my situation. I want to how the genuine vacancy will be treated as I am already employed with them. Please suggest.

Best regards,
Madhavi
