MN1 section 3(2) eligibility?

Post by mintchocs » Thu Jul 26, 2018 3:12 am

Hello everyone, looking for some advice before I pay the hefty application fee.

Looking into applying for British citizenship for my daughter born in 2016 in Hong Kong using the MN1 form.
I myself hold British citizenship by descent from my father who was naturalized under the British Nationality (Hong Kong) Act 1997.
I used to study in the UK for 4 years from 2004 - 2007 so should my daughter be eligible to apply for citizenship under section 3(2) given I did not spend more than 270 days abroad within 3 years?
Bottom line is whether section 3(2) on the MN1 form applies to children born in Hong Kong?

Many thanks in advance.

Yes you can, section 3(2) is applied to you. However, you MUST be able to provide perfect evidences that you never absent from the UK more than 270 days for 3 years (which is very essential as this is the only condition that your daughter can be registered to be British citizen by descent).

Hi mintchocs,

I have a very similar case to yours, can you advise if you processed the application and if you faced any issues?

Thanks
