ILR (5 year Tier 2 General PBS route) and dependents not qualified for ILR

Hi,

I'm in a similar position, I'm completing 5 years on Tier 2 General on 11/11/2018 and my wife is currently on a Tier 2 dependant visa valid till Nov 2019.

My query is :

1) Can I apply 28 days prior to 11/11/2018?

2) Would we need to switch my wife's visa from Tier 2 Dep to ILR Dep, once I get my ILR, or could we wait till her Tier 2 Dep expires in Nov 2019 for her to switch?

1. Yes

2. She DOES NOT need to switch visas. She can stay on her current visa and extend her PBS Dependent visa until she qualifies for ILR with 5 years residence. The rules allows this.
