Spouse visa query

Post by shaiderrn » Wed Aug 22, 2018 10:29 pm

Hi, i am ILR holder, i want to apply spouse visa for my wife i have few questions if someone can reply me

1) I live in a double bed room in a shared house, do i have to get a separate house or double room would be sufficient enough to get the visa. Obviously when shes here i would go for a separate house.

2) My salary is 28K will that be enough if i provide my P60 and Salary slips... also do i have to maintain any funds like 3 months frozen amount showing in a bank statement ?

3) She has to do IELTS or anything else ? Shes DPharm from Pakistan.

4) Should i apply from here in UK and she can submit all documents in Pakistan ? or i should ask her to send me her passport or any other important documents to be sent from here ?

Would appreciate your replies.

Many thanks

1. Double room should be fine if the property is not overcrowded. But you will need house inspection report.
2. yes 28K will be sufficient to meet the financial threshold. you do not need to maintain any fund.
3. she need to do ielts life skills A1/A2/B1. Preferably do B1
4. you need to apply online for her then she will need to enroll her biometrics in Pakistan.

I have got 4 bedroom house and 4 people living with me right now...

What would be the best either to get a different 1 bed flat or something or i can show this will be sufficient enough ? Council is only registered under my name. as its just a new house recently moved in a month ago.

and what would be the best time for me to apply for her visa. Since i heard if she got visa she must travel within 28 days. Basically i am getting married on 20th January so she wants to come back with me so we have to plan our visa thingy in a way that during my stay in Pakistan she gets her visa before my return (10th Feb ) so she could travel with me.

Also questions from gurus, will that impact anything if i left my previous sponsor with a pay of 35k after one month getting ILR and moved somewhere else city with 28K only ?

You can only apply for the visa once you are married. Unlikely she will have the visa to return with you. See the Pakistan timeline thread in the link below. There are delays, even for priority applications.

And on 20th January is our reception ceremony only. I can provide proof of our Nikkah ceremony. Thanks for the timeline thread that will help alot. I will go for Priority one by the looks of it.

I think you are thinking about the things which are far ahead which is indeed a good strategy. Since you are already married and you must be holding some visa right now then why don't you apply for her the dependent visa of that visa. And once she is here and you gets your ILR then within the UK you can apply for her the spouse visa because I don't think you will be able to get spouse visa within one month after your reception ceremony on 20th January.

And the plan is to apply for her visa by November 2018 so that upon my return ON 12 FEB 2019 she would have a visa i assume.

The forum is for immigration issues, not to 'advise' members on their relationships.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Now you have clarified to have ILR. For no reason you are delaying spouse visa despite even now you can apply for her because of being married with her, having double room and earning 28K. Nikkah is a legal marriage in Pakistan which uk accepts even without reception ceremony. But without reception ceremony I believe you must have to demonstrate subsisting relationship proofs like whatsapp/Skype calls/chat, passport entry stamps, tickets, emails etc. Preferably don't wait until Feb 20th.

Bro i was on TIER 2 before so my plan was to get nikkahfied and after getting ILR apply for spouse visa. because my tier 2 was expiring in 6 months time. thats why i waited for ILR.

About subsisting relationship, i have prepared a photobook printed it out and made it on a spiral bound, wondering if i can submit that to proof my relationship ? that book contains all photographs of nikkah ceremony also after nikkah time we spent together. Along with that i got all Whatsapp chat logs dont know what to include in that. and video chat screenshots as well that we talk everyday for 3 to 4 hours. I dont know whether all these are enough or not ? When it comes to visa thing i take so many little things serious and think way out of boundaries take every single thing in to consideration and yes maybe over thinking.... Want to know if the subsisting proof that i mentioned above is sufficient enough or not ?
