Reapply after refusal due to English language test certificate

Post by Ize99 » Sun Sep 23, 2018 4:32 am

Hi,
I already have ILR through Tier 2 and then work permit.
I accomplished my spouse and children for premium service on Friday and they all got it except my daughter that is 19years old. The reason was that she did not have the English language certificate.

I understand from the letter that she can make an application to remain on another basis. The statement was:
'You do not have to leave the UK if you make applications for leave to remain in another basis[/b].'
I do not understand this statement

Does the statement mean I have to apply on a different route entirely or make another application using the SET(0) I used previously?

Can I reapply for her settlement with the SET(0) form? Or do I have to use another form?
If I need to use another form, can someone please advise on the right one?
I followed the family member thread and I'm not sure it's the right one.

Can I use the same documents and add the English language certificate as the only extra document or do I need anything else?
Please we are running out of time and I will really appreciate a response.

Thank you.

If she satisfies all the requirements of 319J, then make another application.

Thank you so much for the quick response.
Yes, she satisfies the requirements and will be taking an English language test this week.

Should the application be made using the same SET(0) form or another form?

Thank you I've seen the responses in the hyperlink.

Can you please advise if it's possible to change a postal application to premium (after posting)?
Thanks again.

SET(O).

What did she submit for the English language requirements?
Does she have her ID to take the test?

Thanks again for confirming the form.

She took a letter from her sixth form school - we thought that will suffice as a proof of English language proficiency as she's been schooling here in the UK for 8 years.

Yes, she has her ID to take for the test.

Hi,
Please following on from my earlier post.
My daughter's certificate from the English test she took on the 25th September is still not out.
She has the result - given to her on that day, but I was advised that we cannot use that for the re application as the result may not be linked to the Unique Electronic Reference (UER) Number. I have called and Trinity says it may take up to a week to link or activate the result.

I am a bit concerned as her stay expires on the 28th of October and I am not sure if this will lead to late application.
With he visa expiring on the 28th of October, when is the latest time she can apply? Please can someone kindly advise?

Thank you.

She must apply by no later than the 28th.

You should have the certificate well before that, it takes about 7 days.

Thank you for your response!

Please do you mean the 28th of September or 28th of October?

October. No later than the last date the visa is valid for.

Hi,
The English language test certificate has arrived and I am about to re apply for my 18 years old daughter's ILR.
Please can you advise on the answers to the following questions based on the SET(0) form:
1. Does she have to complete Section 5 - Your Home and Finances?
She is a student and I have completed the 'Home' aspect, but I am not sure about the 'Finance' aspect - Payslips, Bank statements etc.

The Online form has this section 'The person you are joining or accompanying'. Please can you advise:
2. Since she has been in the UK for over 8 years, do I (as the main applicant - I have ILR) need to complete this section on 'The person you are joining or accompanying' with my details?

3. If yes, will I need to send my Passport and Biometric along with her Application?
I will need to travel in a few weeks time - can I take my Passport and Biometeric to the Post Office for stamp stating they have cited the originals?
4. Will that be valid along with a letter of explanation (if required)?
Kindly advise.

Thank you.
