how early I can book premium service

Hi,

My leave to remain is expiring on 05/01/2019, i was on FLR(M) but at the time of my 1 extension category changed to FLR(FP).

Now I am on 10 years route, so this will be my 2nd extension. Is it still the case that I have to apply with in 28 days of visa expiry ? OR can I apply 35 days earlier ? basically we moved to Dubai and will be visiting UK only for extension hence concerned about how early I can apply for extension.

Your help will be appreciated.

Although there is no absence limit but your relocation to Dubai might not enable you in fulfilling the criteria for cohabitation and other requirements.

My husband got the job who is British national and working in dubai. I moved on 4/06/2018 and now coming for 2nd renewal.

Moved to dubai on 04/06 and now coming back to Uk for my 2 extension. Can I apply on 1/12 for premium service as my visa expires on 05/01/2019 ?

As your and your husband no longer live in the UK, how will you answer the below in the form?
DUTY TO STATE ALL REASONS TO REMAIN IN THE UNITED KINGDOM
All your reasons or grounds for wishing to stay in the United Kingdom must be stated in this
application. This requirement is being given under section 120 of the Nationality, Immigration and
Asylum Act 2002. If you do not tell us now of any reasons or grounds for remaining in the United
Kingdom and you tell us later without good reason, you will lose any right of appeal you may have
otherwise qualified for if we refuse your claim. You can use the box at section 11
.9 What is your partner’s current immigration status in the UK?
British Citizen currently residing in the UK
Provide all addresses that you have lived at in the 2 years preceding this application.
Provide all addresses that your partner has lived at in the 2 years preceding this application.
7.19 Have you and your partner ever lived together outside the UK? (this is a 'yes'/'no' answer
7.20 Could you and your partner live together outside of the UK if necessary? If not, tell us about any obstacles to your family life with your partner continuing outside the UK. Please provide reasons and evidence to support your claim.
Clearly you live outside the UK already!!

Not sure you qualify for an extension as neither of you are present in the UK and in your husbands case, present and settled in the UK.
You must complete this section if you have a partner in the UK. “Partner” means your spouse, civil partner, unmarried or same sex partner.
You can only qualify under the Immigration Rules on the basis of your Family Life with a Partner (10 year route) if your partner is a British citizen or present and settled in the UK, or is in the UK with leave as a refugee or beneficiary of Humanitarian Protection.

Settled in the UK means that a person is ordinarily resident in the UK and they do not have any
limit on time they can remain here

Thanks for the detail but I think I might be under section 8 - Family life as a parent (10 year route).
I have 2 kids who are British nationals, does it help at all ?

Do I still have to fill section 7 ???

The same/similar issues will apply as presumably, your children are living in Dubai with you.

As the children are not living in the UK, why should you be granted a visa extension when you could just start the visa process again when and if your family move back to the UK. You won't have any evidence of schooling, GP records, etc.

Unlikely you are on the parent route as this is usually for a parent who is no longer in a relationship with the childrens other parent.

Have you read the FLR(FP) form at all to see what you are expected to submit?

My daughter is only 4 years and she was going to nursery in Uk and I have proof for it also my son is only 5 months old and have all documentation from hospital.

We own the house and mortgage and bills (mobile/electricity and water) are still getting paid in the same way without any distruption.

Would all the above help, also now I am planning to go to Uk next week which means I only stayed out for 4 months with in last year.

What would be your views on it ?
