Application for an extension of stay

Post by Rubk » Tue Oct 16, 2018 4:50 pm

Dear all

Applied for a spouse visa in 2012 before the rules changed, June 2012. Given a 2.5 years’ visa under the old rules. Before 2.5 visa expired, applied for to extending visa.
Extended visa for 2 years which is expires in 15/12/2018. Due to some family emergency’s had to go back home country for some time.

I am planning to apply an Application for an extension of stay on the basis of family life in the UK as the partner.

Could you please advice, i need to submit the Form (FLR M) 07-18, is that right one?

Many thanks

No, it would be FLR(FP) which is a 10 year route to settlement (ILR). However, where are you now and how long was the period of absence?

Are you aware that you are unable to extend your visa from outside of the UK :?:

You haven't said how long you've been absent from the UK :?:

Why didn’t you apply for ILR after 2 years in the UK?

Initially I got 2.5 years visa in may 2012 but we were in and out from country and didn't prepare for life in the uk test. So instead of ILR we have had applied to two years extension.

Back home mother was seriously ill and need surgery so went few times. Haven't done the life in the uk test yet, according my knowledge I haven't stayed constant 3 year in UK to apply to ILR.

I don't know what to do.

If you were issued with a 2.5 year visa in 2012, how long have you been without a valid visa :?:

How can I live in UK without a valid visa ?? I always had valid visa.. before my 2.5 years visa expired, I applied for an Application ( FLR M form ) for an extension of stay on the basis of family life in the UK ( spouse ) and I got 2 years visa.

Which is expiring in next month. Shall I do the FLR M form again?

Thanks

Provided you haven't been put under Appendix FM. Being granted a 2.5 years extension instead of a 2 years extension is worrying because of A280B. How long was your last FLR(M) valid for? Do you also satisfy D-LTRP.1.1.?

If you satisfy all the requirements for FLR(M) (A227., A277A., A280(c), 284, 285, etc.), then yes.

Don't forget, at least A2 English language, just in case.

2. Appled for extentions from uk visa granted for 12/11/2014 to 12/11/2016

Apply for FLR(M) again under the old rules. State that you are under the transitional provisions and Part 8 of the rules.

You should be eligible for ILR and more likely the supporting documents will be same like previous extension but you will not have to pay IHS at this ILR stage. Also make sure to pass correct English test.
