PBS T2 Dependent VS Spouse visa (Settlement) process question

Hello Guys,

Can somebody here do please enlighten me regarding this matter.

WHY is it thay the PBS tier 2 dependent visa only takes about approx 60 days to process where in the settlement visa for spouse (whos husband/wife has ILR or British) takes around 90 to process?

almost both requirement are identical but why is it that the one with ILR/British takes longer to process compare to non ILR/British sponsors?


Please do help because I need a really good explanation as this is quite very STRANGE.

Not the same at all. Completely different requirements and completely different immigration rules.

Dependent visa by PBS tier 2 sponsors

1. Husband/spouse of Tier 2 migrant
2. English - No need for Tier 2 sponsors
3. Maintainance - Either sponsor of dependent must able to provide
4. IHS fee
5. marriage cert

= aprrox 15 days - 60days waiting


Spouse visa (by ILR/British citizen sponsors)

1. Husband/spouse of ILR/ British citizen
2. English - Ielts or cert of english profeciency
3. Maintainance - Sponsor earning >18,500 (19,000 approx and greater)
4. IHS fee
5. marriage cert
6. proof of marriage i.e pics, convo etc..

= approx 90 days waiting


its like almost the same if not Identical I guess but why is it that it looks like the British or ILR holder takes longer for their spouses to process and those PBS tier 2 looks easy and faster.

I am not a barrister or Solicitor but just wanted to know why??

please dont get mad why Im asking, its because I know someone who is PBS tier 2 holder and her spouse will get the result within 5 days as per VFS priority after attending his biometric scan outside the UK.

My solicitor said no need for priority because its almost the same time you will get the result compare to people who applied priority service.

One is for joining as a dependent of someone on Tier based visa who may qualify to settle later on, the other is coming here to Settle from the beginning.

Similar reason I suppose why visit visas are decided quicker too.

Thanks for the response mate. I was just curious because both needing visa to come in but seems like PBS tier 2 holder are easier to get results compare to British/ILR sponsors. I wonder why British/ILR cannot get the same timeline as for PBS holders. (no offense to PBS holder here )

Different routes = different times

Travelling as a PBS Dependent and Settlement are very different!

It also depends on individual case, you mention about you know someone got it quick, its because 2 cases are not the same.

Very easy answer of this dilemma is that since the tier 2 dependent visa is points based where all need is to achieve sufficient score which gives straight decision whereas the spouse visa of ILR/British citizen is not points based where no scoring but individual circumstances with luck matters.

Yes I know right, Im just wondering if PBS with settlement visa might work faster for all applicants
