ILR EU family member

Post by Stef008 » Sun Nov 25, 2018 9:19 pm

Hi everyone

I came in the UK in 2011 as a student then had my work permit in November 2013. I got married and had changed my working permit to EU family member visa in 2015. Question is can i already apply for ILR given my work permot started 2013 or will they base it on my eu fam member visa that started 2015 and would need to wait 2 more years?

What are the requirements needed and what form to fill in?

Thanks

You need 5 years on the EEA route, counted from the date of marriage if you married within the UK.

So no, you cannot combine your work permit time with EEA RC time to make up 5 years.

Thank you for the reply. My husband have permanent residency and is planning to apply for british citizenship. Will it then affect my visa?

I am on eu family member visa which will expire 2019 november. We got married june 2014 but lived together in UK since 2013. Will the 5 years for PR starts in june 2014 or the year that we have lived together?

From the date of your marriage

Do i need to apply few months before or after? Also, if my husband apply for british citizenship before i get the PR, will my visa status need to change again?

You need 5 full years since date of marriage. You cannot apply "few months before".
