Question about Leave to remain (FLR - MARRIAGE)

Hi there

I was looking for some advice please.

My husband is here on the 5 year route.

After we got married we used form FLR-M and he was awarded leave to remain for 2.5 years.

This year its time to apply again,this time for his second period of leave to remain. However, I am not sure which form to use. Do we use FLR-M again? or do we need to use another form.

I cant seem to find any information regarding this on the home office website, nor is it very clear which form we should use to apply for his second period of leave to remain.

Also when we reapply for his second period of leave to remain - do we pay the healthcare surcharge again?

Any help and adivce would be greatly recieved and appreciated.

Yes it is flr m.

Yes, Ihs is payable again and it has doubled, so will be £1000 for a 2.5 year extension plus the visa fee.

His visa is up in August so am i right in thinking that we cant apply again until the month before? and OMG about the healthcare fee! i didnt know it had doubled! thanks for letting me know!

He should apply no sooner than within 28 days before reaching 30 months residence on his current flr m visa.

His visa is up valid until 22 august. Am i right in saying that we can apply from July 25th?

Also notice it seems to be online applications now? can you still pay more to apply and get a decision same day?

Note also that if he did English A1 test originally, he now needs A2 for the extension.

Thank you for that link! I had no idea they closed all the centres! so im guessing that means that you now get the decision before the leave to remain is up? ( so within the 28 days because its 28 days before the period of leave to remain ends) otherwise what happens if the leave to remain runs out and theres no decison?

My husband is from the USA so he didnt need to do the english test initially.

We now have a 1 year old together but i asked previously and they said it wouldnt change the visa route he was on

You may not have a decision before the current visa expires, but your husband's legal status will remain the same under Section 3c leave.

His existing visa Co ditikns continue if his visa expires while HO is processing his application. This is under Section 3C of the immigrations rules.

You wouldnt happen to know how the fee waiver works would you? I get enchanced rate pip so we dont need to meet the minimum income threshold but we usually always pay the fee? im worried if we dont it might go against us in some way.

Am I right in thinking that 'Mrswow' is referring to form meaning paper form?

If so, my understanding is that the FLR (M) is all online application now?

For a fee waiver, it would likely put him on the flr FP 10 year route. Requesting a fee waiver is also not guaranteed. The UK is no exemption from Ihs though.

Best to stick to current route and pay the fee.
