Changing to contracting from permanent post ILR

Post by adi27 » Thu Jan 31, 2019 12:49 pm

Hello,

I'm currently a permanent employee with my sponsor on Tier2 and will be soon eligible for ILR application. My current employer is ready to provide a letter of assurance of continuation of employment for my ILR application. But I am willing to shift to contracting from permanent while sticking with the same company as soon as I get the ILR. Will there be any restrictions which could disallow me to do so legally? Should I speak to my current employer about this or do not reveal until I get my ILR? Appreciate any advice.

Thanks
Adi

There is no restriction on employment once you have ILR.

That's great to know and many thanks for the quick revert. If I may add to the question further, will I be able to work partially offshore (from India) and partially here once I have an ILR. Will I be facing any issues travelling to and fro from UK for longer periods on a regular basis?

ILR is not indefinite if you do no live in the UK. An absence of 2 or more years and you lose the status. Short 'visits' the UK do not necessarily maintain your ILR status either.

If you have dependents on a visa based on your ILR status, their right to remain in the UK is wholly reliant on you being 'present and settled' in the UK.
