Make sure in the previous 6 months to application date that the account balance hasn't gone below £17,725.

She sends you everything (TB Cert, A1 Certificate etc) and then you send to Sheffield.

She only submits Passport in VFS centre in Bangladesh

What is the exact wording of the refusal letter taking out personal info?

What is each month and job salary per payslips?

Which Category did you apply under?

Category B and D: employment income with cash savings.

I applied using 2 jobs and savings to meet the requirement.

refusal wording:

" you have provided payslips for april, may and july 2018 from your sponsors employment with XXX and therefore do not meet the requirement as above.
Furthermore, the employment letters from Job 1 and Job 2 show your sponsors annual income is £9771 and £8143. I am not satisfied that this employment shows you meet the £18600 threshold.

with the 2 jobs i earn £17,910..and i had savings over 24k to use to meet the finiancial requirement.

so why didnt the home office count my savings?

Didn't you send covering letter?

we did..my solicitor even wrote a declaration letter and 2 page cover. i have copies of everything.

I even had a telephone interview few weeks ago.
why is the home office doing this to us?

the ECO just ignored everything..they ignored my savings.

my solicior advising me to appeal, but i am worried it will take over 1 year. we already waited 3 years.

what should i do??

Spouse Visa Refused due to Home Office Error 2018

Post by uddin000 » Fri Jan 11, 2019 5:19 pm

Hi all i need your advice..my spouse visa was refused on 27 december 2018.

I applied with 2 jobs and savings. so thats

Category B: 2 employement jobs ( total £17,910)
Category D: cash savings combing with income (£24,900 held in current account for over 6 months)

but the ECO ignored the category D: cash savings they refused it saying its not £18,600 requirement.

also they claim they only got 3 payslips out of 6 in my 2nd job..this is impossible..we sent all 6 payslips in the supporting bundle and all 6 payslips came back from the home office.

Do you think its worth appealing? if it goes to court, do we have any chance of wining or is it better to apply again?

thanks

I suggest you to involve your MP amd explain to them as going through appeal process is longer. Thats what i did, my husbands visa got rejected that we submitted invalid TB certificate but it had over 4months date still left. It took me 2/3 weeks to get respond from MP and then MP contacted home office same week and she got respond within 2weeks from Home office and they overturned decision. So now i just paid for IHS n submitted passport this week. Plus it didnt cost me anything extra and its quickly then appeal as that can take upto 12months and peoples experiences that i have seen so far they take atleast 9/10months to respond

I think it must have been category A with 2 jobs conbined with savings. Cover letter to explain all that was required. Missing on payslips is home office fault

Hi on the application form we stated we meet the financial requirement through category B and category D...my solicitor completed it.we provided 6 months payslip from each 2 jobs. (12 payslips total) we did provide cover letter and affidavit.

there was no mention of my cash savings in the refusal letter as we did state this application form using category D to combine savings with income category B.

Keep chasing the MP, like keep ringing them two to three times a day plus an email everyday... thats what i did i called them for three days in a row and on the 4th day they contacted me back themselves. Leave a voicemail everytime the call isnt answered. I just emailed twice before n i heard nothing for whole week then i started calling.
