Accomodation requirement for spouse visa

Post by southern456 » Mon Sep 30, 2019 9:45 pm

Hi

I am applying for my non EU spouse's visa soon. I have a house that I coown with my ex wife.. Since our divorce I rented a flat to stay, i used this flat's address on my certificate of no Impendiment and later on her TB test results as well. But I had to leave that flat after 1 month as my job location had changed. Since then I've been staying in a flat share. I was hoping to use my previous flat's address that I rented for just 1 month as my last parament address which is also a fact. Would this be ok? Or should I rent another flat before lodging the application ? My job location my change again so I'm hesitant in renting a place till my spouse arrives in UK.

If anything issued on previous address then it will cause no issue. For meeting the accomodation requirement and keeping the process more straightforward preferably don't move anywhere or change job until the visa gets processed. If at your present flatshare you have at least one double room and landlord is willing to write a noc letter for your partner then you may even use that address. For this you will have to attach property inspection report.

Thank you so much for the quick reply. Does HO actually check to inspect the accomodation ?

Yes especially where they suspect there is subletting or overcrowding.

Oh I see

So I guess I'm better off renting a new place of my own then risking the HO inspecting the shared accommodation?

Good idea. But before securing/signing any tenancy clarify to the landlord what will you need from him/her to avoid any inconvenience at later if they will be not cooperative. If you get an independent flat then you will only need tenancy agreement and noc letter along with council tax (optional).

Just continuing on the discussion from yesterday

If I take a double room in a shared accommodation, making sure there is no overcrowding issues and I agree on a letter and inspection report etc from landlord beforehand, would this be ok? Or would our case be better served if I took a flat entirely in my name again with the letter, inspection agreed with landlord. I guess what I'm asking is, would HO sneer at a double room in a shared accommodation. The concern for me is obviously cost ( almost double for flat)
Also, does the length of tenancy matter? I can get a double room on short term let, not so with a flat.

Interesting though that you registered this second username on the 29th Sept but logged in as the sourthern456 username last night, 30th at 9:45pm!

I will deactivate the sourthern456 username.

If you can afford then preferably take the entire flat even studio typed because even in shared accomodation if you can be able to convince the landlord in getting the noc letter but how about the other residents there whose detail need to be given on the application as well. Will they be ready for that?

It is a letter you simply need to write. We do not have a whole bank of blank template letters for every occasion. You need to write it (or your landlord does) based on your situation.

It is a 'no objection' letter.

Ok understood, will do.

It's a no objection to my spouse staying with me at the rented place, right?

Also a tenancy agreement whether you will live in shared or independent flat.

Spouse Visa - Financial requiremetns

Post by ThisOneOnMe » Mon Oct 21, 2019 4:58 pm

I am the director of a Ltd Company in the UK. I am applying for my wife's spouse visa. She is a non EU national.
My company's year runs from December to November every year.

I am submitting all financial requirements documents ( CT600 etc ) from last year ( 2017-18). Is this ok ? As the new accounting year is about 2 months away. Should I wait till after 2018-19 annual returns and CT600 are filed?

One alternative is to get projected accounts for the year 2018-19?

Thanks

Ok thanks CR001

I actually thought is better to create a separate topic as its a different aspect of the same application. Understood now, thanks.

You will have to provide the documents for either the last full financial year (Category F) or the average of the last two full financial years (Category G), so you would not be able to use projected accounts. You do, however, also have to provide evidence of ongoing employment in relation to income and/or shares. Whether you use the 2017-18 returns or wait for the 2018-19 returns shouldn't matter, either should be fine.
