You can apply no sooner than within 28 days before the start date of your initial spouse visa.Yes, the initial visa granted in December 2015 was granted in the UK, I have been here legally since January 2011, first on Tier 4 student then Tier 2 general. I then got married in 2015 and moved to the 5 yr route.
There would have been a paragraph about this in your last approval letter, stating it very clearly. It is also contained in the old paper SET(M) Guidance notes. Note also that the 28 days concession is not an immigration rule, but specifically a concession granted by UKVI to ALL applicants for immigration applications within the UK.I have been looking around and cannot see anywhere it says the early 28days is applicable to the 5 yr route.
5. When To Apply
You and any children under 18 who are applying with you should apply before the end of your/their permitted stay in the UK when you are nearing completion of the qualifying period required by the Immigration Rules.
Please do not apply more than 28 days before completing that period. If you apply earlier than that, your application may be refused. If that happens, we will not refund the fee and you will have to pay again when reapplying
You can't don't qualify for a British passport directly. You have to apply to naturalise as British first, which can take up to 6 months. You are only British, and eligible for a British Passport, AFTER you have been approved and attended your ceremony.I am trying to apply at the earliest possible and then for a passport the very next day (because of a potential job opportunity) as my wife is British.

I have have all the payslips covering the last year including this month, Oct, I will also be able to get a letter showing start and end date of my employment. I earn more than the minimum amount required.
My questions are
1 What do I put on the application as current job? I will be jobless at the time of application
2 I am assuming money earned in current employment (which will end before application date) should suffice, how do I explain my situation? with a letter included in application?

What is quite simple, is if members simply follow the rules and read them when they join as you are required to. Apologies for asking another silly question. If documents are returned, does this mean I can travel after applying (before a decision is made)? my current BRP does not run out until March 2021. I am scratching my head. How could this possibly be? The requirement doesn't say you must have a job at the time of application. My finish date in current job is 31st of October and I am applying for ILR on 12th of November, I have all paylips to end of Oct, letter from employer, statements etc. I thought the financial requirement is based on last six months prior to application. 1. Without having a job you won't be able to meet the financial requirement. There is a temporary concession in place over temporary loss in income instead a permanent lose of job.
2. That will only be possible if you be able to find a new job and then apply under category B.
However, if you have cash savings then these can be used on lieu of any other income (if sufficient).
