Hello All,

Quick question please, I am approaching 5 years on the 5yr spouse visa route. The visa itself doesn’t expire until March 2021 but it was first issued on 1st of December 2015 and renewed in 2018. Can I apply 28days before the 5yr anniversary of the visa - 3rd of Nov? Or do I have complete my 5yrs sentencing in full? Does the 28days early grace period apply to this category? I have not seen this anywhere.

The 28 days concession applies to all visa categories applying for ilr.

If your initial visa was issued within the UK (your post isn't clear if it was), then it counts from the date it was granted/brp date.

If you applied from abroad, then the residence period starts counting from the date you entered the UK.

Yes, the initial visa granted in December 2015 was granted in the UK, I have been here legally since January 2011, first on Tier 4 student then Tier 2 general. I then got married in 2015 and moved to the 5 yr route.

I have been looking around and cannot see anywhere it says the early 28days is applicable to the 5 yr route.

The category is not covered in the 'Indefinite leave to remain: calculating continuous period in UK Version 20.0' document. I am trying to apply at the earliest possible and then for a passport the very next day (because of a potential job opportunity) as my wife is British.

You can apply no sooner than within 28 days before the start date of your initial spouse visa.

There would have been a paragraph about this in your last approval letter, stating it very clearly. It is also contained in the old paper SET(M) Guidance notes. Note also that the 28 days concession is not an immigration rule, but specifically a concession granted by UKVI to ALL applicants for immigration applications within the UK.

5. When To Apply
You and any children under 18 who are applying with you should apply before the end of your/their permitted stay in the UK when you are nearing completion of the qualifying period required by the Immigration Rules.

Please do not apply more than 28 days before completing that period. If you apply earlier than that, your application may be refused. If that happens, we will not refund the fee and you will have to pay again when reapplying

You can't don't qualify for a British passport directly. You have to apply to naturalise as British first, which can take up to 6 months. You are only British, and eligible for a British Passport, AFTER you have been approved and attended your ceremony.

If ILR is obtained as spouse of British Citizen, there is no requirement to wait for 1 year before applying for naturalisation.

Morning All,

Just wondering if anyone has been in a similar situation or knows how to navigate through this.

I am applying for ILR on 12th of Nov. It's my last day at my currect job on the 31st of Oct as I have been made redundant. I have have all the payslips covering the last year including this month, Oct, I will also be able to get a letter showing start and end date of my employment. I earn more than the minimum amount required.

My questions are

1 What do I put on the application as current job? I will be jobless at the time of application
2 I am assuming money earned in current employment (which will end before application date) should suffice, how do I explain my situation? with a letter included in application?

1. Without having a job you won't be able to meet the financial requirement. There is a temporary concession in place over temporary loss in income instead a permanent lose of job.

2. That will only be possible if you be able to find a new job and then apply under category B.

However, if you have cash savings then these can be used on lieu of any other income (if sufficient).

Apologies if answers to my questions are obvious, I just wanted to know what date counts as application date. Would this be the date payment is made online or when you go and enroll for BRP? I have just completed the online form and gathering docs. Also, what happens to applicant and spouse's passport? Are these posted to the Home Office? or collected at the BRP centre and returned at a later date? I am on the 5 yrs spouse route and will be due to apply for ILR on the 12th of November. Thanks

Date of application is the date you pay and submit online. All documents are scanned and uploaded. No originals are sent. You have to attend a biometrics appointment at UKVCAS as part of your application. Documents will be checked and originals will be returned.

What is quite simple, is if members simply follow the rules and read them when they join as you are required to. If they persistently don't and ignore the forum rules, their access will be restricted or terminated without notice.

Apologies for asking another silly question. If documents are returned, does this mean I can travel after applying (before a decision is made)? my current BRP does not run out until March 2021. Thanks very much

I am scratching my head. How could this possibly be? The requirement doesn't say you must have a job at the time of application. My finish date in current job is 31st of October and I am applying for ILR on 12th of November, I have all paylips to end of Oct, letter from employer, statements etc. I thought the financial requirement is based on last six months prior to application. I have already earned above the £18600 in the last six months. Thanks

Initial spouse visa was granted 10th of Dec, so the 28 days window brings me to 12th of Nov. If this loss of Job is going to be a problem, could I apply on 30th of October then? I should be within the 28 days when a decision is made on my application.

This manoeuvre is relatively safer because on the date of application, academically, you will be employed whilst remaining covered by virtue of section 3C, and be benefited from the caseworker's discretion where you need to qualify on the date of decision.
