more than 20 hours a week. 12 months ago.

Post by nibe » Fri Apr 12, 2019 9:53 am

hello everybody.

im on a tier 2 visa. i am on my 5th year.
however 12 months ago.. i was working 24 hours a week on my second job. just for 1 month. as i found out that it was not permitted.

will this affect my ILR application as this happened 12 months ago? can the home office still detect this?

i quit my second job after 1 month.

Possibly yes as that would have been a breach of your visa conditions.
can the home office still detect this?
Yes, because they check your HMRC records.

Yes, because they check your HMRC records.
what can i do to fix this? does it mean that i have to go home after my contract expires? as i am not eligible for ILR?

thank you for your quick response.

The other question is, was this second job the same level and SOC as your main tier 2 job??

HO might overlook it, they might not. Difficult for anyone to say. I was merely say it is possible as HO have access to your income records on HMRC, so depends whether they look into further or not.

yes.. the same soc code.. same job description.

hmm.. the ILR fee is 2400+800. it is a big gamble.
if only i can return my salary, i will return it.

ohh.. thank you.. i might have a chance with ILR then.. because until now, a year has passed.. they have not curtailed my visa yet. even if I violated the "20 hours a week" rule back then.

i will update you all if my application is successful or not.

thank you.
