FLR(M) spouse visa extension: No payslips

Post by Samar85 » Sun Aug 26, 2018 11:17 pm

I have been in the UK for 2.5 years and am now applying to extend my spouse via BRP.

My husband works as a doctor in a GP surgery. His income is above the minimum £18600 requirement and is consistent from month to month. However, because he is a Partner in the practice and not paid like a normal employee, he has no payslips. Rather than a 'salary', every month the payment he receives is what is drawn from the monetary value of the partnership.

His practice manager has written a letter confirming his employment status. She has also outlined how much he is paid from month to month, for the last 2 years. The letter also states that there is no record of payslips because of the way the partnership works.

We are including bank statements with my application. These statements show the income my husband receives each month.

My question:
Without payslips, will my application still be successful?
Is there any other document we could provide (in addition to the employer's letter) that might help?

Thanks in advance

If he is not getting paid like normal employees but still must be paying taxes on what he has been withdrawing/getting and if so then he might be self employed which requires extensive range of paper work than a normal employee. However, on the other hand if you are earning at least £18600 or if either of you have at least £62500 six months older savings than can use it alone to meet the financial requirement.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Thank you for your reply.

So if his status would be 'self-employed', what is the extensive range of documents we need to provide for this? Would you be able to list it here or copy a link to another post with the same?

Thanks

FLR(M) Self-employed, tax return

Post by Samar85 » Mon Aug 27, 2018 10:54 am

Dear all,

I am extending my spouse visa after my first 2.5 years in the UK.

Using my husband's income as proof of finances. If providing tax returns as financial evidence, is a printed copy of an e-tax return acceptable? My husband's tax returns have been filed by his accountant online for the last 2 years. He has electronic copies but no hard copies.

If he takes printouts of these, is it sufficient? Or do they need to be signed/attested by someone to say they are genuine (and if so, by whom?)

Thank you

FLR(M) Question on 'Leaving the UK'

Post by Samar85 » Tue Aug 28, 2018 8:45 pm

There's a section on the FLR(M) extension form that says:

"Are there any factors which would make it difficult or impossible for you to integrate and establish a private life in that country?"

I'm assuming this is probably directed at people who, for example, might face persecution in their country of origin. I am fortunate to not have any such problem. However, I don't want to answer NO to the above question. My family is in the UK so if I got separated from them that would make it very difficult for me to establish life once again in my country of origin.

So, is it reasonable for me to say: YES. My husband and child are here, and therefore I cannot move back to my country" ?
I feel like it's stating the obvious but wanted to see if it's worth saying anyway.

Thank you

My wife's BRP expires on 7th September. We submitted her FLR(M) extension application last night and paid for premium service. However, the earliest appointment is 25th September.

We have taken the appointment, but does it matter that by the time we attend the premium appointment her visa would have expired 2 weeks earlier?

Hope that doesn't given an automatic rejection!!

You must apply in person before the date the current visa expires.

So what you're saying is that our situation (expiration September 7th, in person appointment September 25th) is not going to get approved?

Do you know of a way we can change it so that we can cancel the premium appointment and just send off the paper application instead? At least that way they will receive the papers on time.

We've paid an extra £600 for the premium appointment!! Worried now.

HomeOffice will use the date of online application as your submission date. Therefore if you book an appointment (paying premium) after the visa expiry your visa wouldn't be refused.
I know people who were in same situation as you and they didn't face any problem.
