FLR(M), ILR, early visa

Hi there,

I am a British citizen and my wife is dependent on my since 1/Dec/2014.

Tier 1 dependent from 1/Dec/2014 - Feb/2016

FLR (M) – Feb/2016 – Oct/2018.

Now I am planning to go for her visa extension a bit early (40 days in advance) due to travel plan. Will there be any issue to go for the extension early?.

Can I count Tier 1 visa time also towards her ILR?.

Yes, she will have a shortfall for ILR which require an additional 3rd extension to cover the shortfall before applying for ILR. Are you applying by post or in person???
Can I count Tier 1 visa time also towards her ILR?.
No.

I am going for same day service. I am okay with the 3rd time extension as long as there is no issue with the early application. Even if I can save some money on application then I will apply by post more early if that allows me to apply (anyway I have to apply 3rd time extension which gives me 2.5 years).

When are you applying in person and when are your travelling (leaving and returning)?

Got it. Its going to be so expensive. Visa expires on 25/October. I am planning to apply somewhere in September. Travelling on 6th October. But my only worry is if I apply on 28th September (which is 28th day of expiring visa) can I get the visa within a week including BRP.

What was the date of entry on the spouse visa??

BRP cards take between 7 and 10 days to be delivered by DX Couriers, sometime it is quicker and sometimes it takes longer.

What is the return date to the UK?

Forgot the return date. She will stay in India for 4 months. Expected date of Travel to India is 6/October

Hi there,

Can I apply FLR(M) visa from India?. My wife is in UK at the moment but she has to travel soon before her visa expires and dont have the chance of applying within 28 days period. So just to avoid the 3rd time extension I am looking in to all the possible options.

how can she travel to india without passport which must be kept at HO.

Hi Guys,

In the online application HO asking for the parents birth certificate. But I never had one. I can't go and get one now as it takes time and expensive one. I have seen similar question raised by the some guys but NO answer or suggestion for this. Any advice here please.

Hi,

For FLR (M), I need to show £18,600 for my wife on both of us. Combinedly getting up to £21k. which is more than enough.

I am a contractor so working for my own company. I am the director and myself and my wife both are employees also getting the basic pay from the company. This basic salary itself coming to £21k.

My concerns are:

1. As a director of the company I am giving a letter on the company’s letterhead confirming all the employment and salary details.
2. As I am also showing up my salary in order to meet the financial requirements (£18600). My accountant said you can provide this info myself as a director of the company. Will there be any problem with it because I am the director and employee also.
3. My wife is getting the maternity pay from last 4 months. Do I need to fill anywhere in the application form with this info?. Still I am mentioning this on the letterhead in the salary section.
4. As I already met the money requirement I am not showing dividends etc so I believe the HO will not ask for this info.

Hi,

I am the director for my Limited company. Both myself and my wife are share holders and getting basic salary every month.

She is going for the FLR(M) next week and we are only showing up the salaries to meet the £18,600 target and we met more than that. When I checked with one of my friend he said I need to show limited company tax returns as well. Is that right?

Hello Guys,

It will be helpful for any other waiting for this info.

When you are the director and the employee of the Limited company & also your spouse is shareholder and employee.

1. Make sure CT600 submitted
2. carry the Business & personal bank statements covering that CT600 period.
3. You have to carry the present personal bank statements anyway if you are claiming the funds from salary.
3. Self assessment returns
4. Accountant letter covering the CT600 period.

Hello. I am also a Limited Company Director and had went for my ILR (SET-M) few months back. You wont be able to use only pay slips as like other normal employees. I would suggest you to go with all the below details.

Source: https://www.gov.uk/guidance/immigration ... d-evidence

(i) Company Tax Return CT600 (a copy or print-out) for the last full financial year and evidence this has been filed with HMRC, such as electronic or written acknowledgment from HMRC.
(ii) Evidence of registration with the Registrar of Companies at Companies House.
(iii) If the company is required to produce annual audited accounts, such accounts for the last full financial year.
(iv) If the company is not required to produce annual audited accounts, unaudited accounts for the last full financial year and an accountant’s certificate of confirmation, from an accountant who is a member of a UK Recognized Supervisory Body (as defined in the Companies Act 2006) or who is a member of the Institute of Financial Accountants.
(v) Corporate/business bank statements covering the same 12-month period as the Company Tax Return CT600.
(vi) A current Appointment Report from Companies House.
(vii) One of the following documents must also be provided:
(1) A certificate of VAT registration and the VAT return for the last full financial year (a copy or print-out) confirming the VAT registration number, if turnover is in excess of £79,000 or was in excess of the threshold which applied during the last full financial year.
(2) Proof of ownership or lease of business premises.
(3) Original proof of registration with HMRC as an employer for the purposes of PAYE and National Insurance, proof of PAYE reference number and Accounts Office reference number. This evidence may be in the form of a certified copy of the documentation issued by HMRC.

(c) Where the person is either listed as a director of the company, or is an employee of the company, or both, and receives a salary from the company, all of the following documents must also be provided:
(i) Payslips and P60 (if issued) covering the same period as the Company Tax Return CT600.
(ii) Personal bank statements covering the same 12-month period as the Company Tax Return CT600 showing that the salary as a director or employee of the company (or both) was paid into an account in the name of the person or in the name of the person and their partner jointly.


(d) Where the person receives dividends from the company, all of the following documents must also be provided:
(i) Dividend vouchers for all dividends declared in favour of the person during or in respect of the period covered by the Company Tax Return CT600 showing the company’s and the person’s details with the person’s net dividend amount.
(ii) Personal bank statement(s) showing that those dividends were paid into an account in the name of the person or in the name of the person and their partner jointly.
(e) For the purposes of paragraph 19(a), evidence of ongoing employment as a director or other employee of the company or of ongoing receipt of dividend income from the company must be provided. This evidence may include payslips (or dividend vouchers) and personal bank statements showing that, in the period since the latest 12-month period covered by the Company Tax Return CT600, the person’s salary as a director or employee of the company (or both) (or dividend income from the company) was paid into an account in the name of the person or in the name of the person and their partner jointly. Alternative evidence may include evidence of ongoing payment of business rates, business-related insurance premiums or employer National Insurance contributions in relation to the company.
