She won't qualify for citizenship as she has likely exceeded the absence limit in the last 5 years if she has been out of the UK since May 2018.

A child born abroad to a British citizen father is British by descent.

There is NO absence limit for spouse visa holders. However, for an extension on FLR(M), you are required to show UK proof of earnings meeting the financial requirements AND evidence of cohabitation while living in the UK. Brexit affects the EEA/EU route applications and NOT the UK immigration rules ...

If she is over 18, then she is considered an adult and cannot apply as your dependent for a settlement visa. Why did you not sponsor them to the UK in 2008, which would have been substantially easier than trying to sort a mess like this out now when they are 25. Unclear from your post if you applied...

Appendix J Table 9 of the Immigration rules clearly states the below. You were an overstayer for more than 3 months. Your previous posts state your student visa expired in April 2016 but you only left the UK June 2017. It is NO as your cos was not a shortage one. Only cos issued/assigned on or after 6th October 2019 are shortage.

Note that if you choose to apply for the spouse settlement visas, they can take a long time from India, anywhere between 60 days and 6 months.

You need a visa before travelling.

There are only exemptions if you hold a short term visa, ie visitor visa, issued which states bivs.

Extant leave means valid visa, or applying anytime before your visa expires.

Date of application is the date your submit and pay online.
