The reason was that my wife`s passport attached to the application had expired although I supplied all other documents like P60,wage slips etc.It was a silly reason given by HO at that time.This time I provided my spouse valid national ID card in court You can follow my story here: http://www.immigr...

Why appeal if the only reason for refusing your application is your passport not being included, then send it to them and stop the hassle of appealing and save yourself some money.It costs money to appeal if you are going for a lawyer.

No,

But you need prove to show that your ex exercised treaty rights before you divorced, more importantly the time you start the divorce proceedings to the time decree absolute was granted.

The letter from the tribunal indicates that you(the appellant has withdrawn the appeal) so what help do you need again.If you have withdrawn the appeal but the got the necessary documents now, then make fresh application.
