But you need prove to show that your ex exercised treaty rights before you divorced, more importantly the time you start the divorce proceedings to the time decree absolute was granted.

The letter from the tribunal indicates that you(the appellant has withdrawn the appeal) so what help do you need again.If you have withdrawn the appeal but the got the necessary documents now, then make fresh application.

No,you can do one at a time.Either you allow the appeal process to go on or withdraw the appeal and make fresh application.

Your solicitor is arguing on technical grounds but the only way that your stay in UK will be legal is to appeal to the upper tribunal,in that case your stay is legal as you wait for the hearing of your appeal.
