Re: Naturalisation and Excess Absences

I obtained citizenship in October 2013 and requested discretion be applied. 1.) I did not own any property. I rented. I had no property in any other country. I had my primary pension in the UK. I am a solicitor qualified in England and Wales - so professional ties to the UK. 2.) My husband was (and ...

Re: Queries

I'm always caught out on that calculation, milan69. It's from the date HO receives the application - if they receive it on 20 July 2014, she would have needed to be in the UK on 21 July 2009. Your daughter is eligible for registration now. So you can submit her MN1 with your application in April or ...

Re: Help! Is No Further Action equal to Pending prosecution

It just means that the police are not going to pursue the matter either way unless more evidence comes to light. Considering it's been two years, I doubt it will. It is just a letter informing you that the police are parking (excuse the pun) the investigation, but reserve the right to resume the inv...

Re: MARRIAGE OUTSIDE OF UK IS THE SAME THAT MARRIAGE IN UK?

As Wanderer said, you can apply for a fiancee visa so you can marry in the UK or you can marry in your country and then apply for a spouse visa. https://www.gov.uk/join-family-in-uk/overview This link explains the eligibility requirements and links to apply for the visa. You may also want to use thi...

Re: Naturalisation - 3 years residence based query

If applying as a spouse of a BC: The residency requirement is that you were present 3 years prior on the date the HO receives your application - not the date your husband takes the oath. Even if you send the application on 18 March 2014, HO won't receive it until the next business day. The qualifyin...

Re: Naturalisation - Novemder Application

It's not based on nationality. That is quite clear on the information also collected. What the UKBA agent said wasn't inaccurate. They are still considering applications pre-3 November. Not all of those applications have been resolved. That doesn't prevent applications after that date to also be con...

Re: Please Please give me Suggestions I am in trouble

With all that time studying, surely you've obtained a UK bachelors or masters degree, postgraduate certificate in education or professional graduate diploma of education? If so, why can't you try to get an employer to sponsor you under a Tier 2 (General) visa?

Erm, I do not think you should be disappointed. People give their free time to answer queries on this board. Membership levels are given based on posts made - not because they are paid employees.

Re: MARRIAGE OUTSIDE OF UK IS THE SAME THAT MARRIAGE IN UK?

Marriage and civil partnership are two different things. However, the important thing is whatever you enter into needs to be recognized under UK law. In any event, if you are married then you do not have an automatic right to a visa. There are a number of requirements that you and your partner would...

They are criminal as they're issued because you broke the law (which is a criminal law - not civil). However, they are not criminal convictions or cautions if they are not referred to court. There is a section on this on the Good Character Requirement FAQ thread ( http://www.immigrationboards.com/br...

Re: Class 2 NI and Naturalisation (need immediate assistance

My opinion is that you shouldn't be concerned because you've contacted HMRC and are rectifying the issue. If UKBA does check with HMRC (which will be in a few weeks' time at the earliest), you will probably have resolved the situation. In any event, HMRC has told you that this was an error on their ...

You only need to provide a marriage certificate to prove change of last name.

Re: Section 1.6 - Form AN

I put my first and middle name in Section 1.6.

I would put my full maiden name (first and last name) in Section 1.7 if there is enough room. If there isn't enough room, put it on page 15 (additional info) and reference page 15 in Section 1.7.

Re: Child born in UK, Father on Tier 1 , Mother on Tier 2

Was your child born in the UK?

If so, when one of his parents (you or your wife) obtains ILR, he'll be eligible for registration as a British citizen under section 1(3) British Nationality Act. He'll be eligible regardless of whose dependent he is (for visa purposes) at the time of registration.

Re: Can I apply for BC before end of 12 months time restrict

There isn't a list of what would or wouldn't be compelling or compassionate reasons. However, if you read the document, you'll be able to read between the lines of what may allow discretion to be exercised. For example, 4.1.2(d) states: exceptionally compelling reasons of an occupational or compassi...

Re: New English Assesment master degree

No, a letter from the university is not sufficient. If UK NARIC's Statement of Comparability does not state the course was taught in English and the PBS doesn't award points for English Skills for this degree then UKBA will not recognize the degree as being taught in English.

Re: Naturalization

The simple caution shouldn't affect your naturalisation application as it's over 3 years since it was given. However, you should declare it on the form. Not having your the passport is going to suck a bit. You will need to provide another form of ID to prove your identity, other documents to prove y...
